PROCEDURES

            Identification and Referral of Students with Disabilities Under Section 504

                       

                        Any student who has or is believed to have a disability under Section 504 of the Rehabilitation Act of 1973 may be referred by a parent, guardian, teacher, or other certified school employee to the Building 504 Evaluation Team for evaluation and possible identification .of the student’s disability and individual needs.

                       

                        The 504 Evaluation Team shall consist of members who are properly trained and knowledgeable about the student, the meaning of the evaluation data, the individual needs of the student, the student’s history and the accommodation options.

                       

                        The 504 Evaluation Team shall consider the referral and, based upon a review of the student’s existing records, including academic, social, and behavioral records, make a decision as to whether and accommodation under this program is appropriate.

                       

                        Evaluation

                       

                        Evaluation of the student and formulation of the accommodation plan will be           carried out by the 504 Evaluation Team according to the following procedures:

                 

                       The 504 Evaluation Team will evaluate the nature of the student’s
          disability and the impact of the disability upon the continued education of
          the student.

                 

                       No final determination of whether the student will or will not be identified
         As disabled within the meaning of Section 504 will be made by the 504
         Evaluation Team without first inviting the parents or guardians of the
         Student to attend any meeting at which the determination will be made.  
         A final decision will be made by the 504 Evaluation Team in writing.  At
         That time, the parents or guardians of the student shall be notified of the
         Section 504 procedural safeguards available to them.

                      Plan for Services

                       For a student who has been identified as disabled within the meaning of Section          504 and is in need of specific accommodations, the 504 Evaluation Team shall               be responsible for recommending what a special services or aids are needed.           In making such a determination, the 504 Evaluation Team will consider all
         available relevant information. The parents or guardians will be invited to attend
         the 504 Evaluation Team meetings. When a determination of the reasonable aids
         and services for the student will be discussed. The parents or guardians may
         examine all relevant records.

                       The 504 Evaluation Team will develop a written accommodation plan describing
          the aids and services to be utilized. The plan will specify how accompanying aids
          and services will be provided, and by whom.

                       The 504 Evaluation Team may also determined that no special services are
          appropriate. If so, the record of the 504 Evaluation Team proceedings will state
          the basis for the decision that no special services are presently needed.
          The 504 Evaluation Team will notify the parents or guardians, in writing, of its
          

                        Final decision concerning the aids and services to be provided.

                        Procedural Safeguads

                        The parents or guardians will be notified in writing of all decisions concerning the
          Identification and evaluation of the student, and the accommodations plan. The
          parents or guardians may examine any relevant records.

                       As to any decision by the 504 Evaluation Team concerning identification,
          evaluation, or the accommodation plan, the parents or guardians shall have the
          right to a hearing (“Section 504 hearing”), with the opportunity for participation
          by the parents or guardians of their counsel.  The parents or guardians also have
          the right to request mediation as a method of resolving conflicts or disputes
          regarding identification, evaluation, or the accommodation plan.
