The records, books, and papers of the school district shall be made
available to the public, providing:
- the request to view the record(s) is made to the
Records Access Officer, in writing, at least 3 business days in
advance of the expected viewing date. This timeline may be waived by
the district at its option.
- a designated district employee is present when the
viewing of the records is taking place.
- the record(s) is examined in a location, within the
district, designated by the district.
- the viewing of such record(s) takes place during
normal working hours.
- that any record to be copied shall be requested, in
writing, to the Records Access Officer.
The cost of this copying shall be at a charge of 25 cents per
page, and only one copy of a record shall be provided.
- the requested record(s) is/are available under the
designation of the Freedom of Information Law, Public Officer’s Law,
Section 84-90.
If a
person is refused access to a specific record by the Records Access
Officer, he/she may request, in writing, that the Superintendent provide
this access. The
Superintendent will review the matter and send his decision to the
applicant, the Records Access Officer and appropriate State Officials. The
applicant may appeal the decision of the Superintendent in the
manner provided under Article 78 of the Civil Practice Law and Rules. |
